7.8.2.2. AUTHORIZED PURCHASE OF LOW RISK SOFTWARE WITH A PROCARD

  1. Low Risk Procurements Only.  ProCard purchases to secure software through use of a Clickwrap Agreement are acceptable for very low risk procurements (“Low Risk Software”) with a term not to exceed one (1) year from purchase date and a total purchase value that is no greater than the Departmental Maximum (as defined in Section 7.8) or $15,000, whichever is less.

  2. Process and Responsibilities for Purchasing Low Risk Software with a ProCard. Before making a purchase of  Low Risk Software with a ProCard, the Cardholder must ensure that the University does not have a separate license for the software (see Section 7.8.2.1(C)), that a license is not available through DIR (see Section 7.8.2.1(D))  and that the purchase does not have attributes that would classify it as higher-risk (see Section 7.8.2.3(A)). Upon making those determinations, the Cardholder may purchase Low Risk Software with a ProCard. To purchase Low Risk Software from a vendor that is not based in the United States, Cardholder must (i) request and obtain approval from Export Compliance; and (ii) approval confirmation must be included in the supporting documentation provided to Departmental Reconciler.

  3. Accessibility Requirements for Technology.  If software is secured under this policy and item is found not to be in compliance with accessibility requirements under Subchapter M, Chapter 2054, Texas Government Code, then an alternative accessibility option must be offered and approved by the University’s Electronic Information Resources (EIR) Accessibility Coordinator.  If an alternative method is not approved, then the department or college must cease use of the technology and promptly terminate the related contract.
